Terms of sale
These terms cover every acquisition of an original work, a signed limited edition, or a private commission by Didier Breteau — whether the conversation begins on this site or by email. Making an enquiry means you have read and accepted them.
Who you are dealing with
The business that operates this site and sells the works is registered and operated from Kuala Lumpur, Malaysia. The works are painted by Didier Breteau in Châteauneuf-du-Rhône, Provence, France, and are dispatched from France — so your contract is with the seller, while the parcel leaves Europe. Write to studio@didierbreteau.com for anything at all.
An enquiry, not a checkout
Nothing on this site can be bought with a card. Works are shown with an indicative starting price, and the bag icon opens a Selection, not a cart. Submitting a selection or a contact form is an enquiry: it places you under no obligation, and it does not reserve a work. A sale exists only once the seller has confirmed the work, the total price and the terms to you in writing and you have accepted them.
The works
Every original is a unique piece, painted by hand in watercolour or acrylic and signed by the artist. Limited editions are signed and numbered within a stated edition size, and come with a certificate of authenticity. Because each piece is made by hand, the photographs on this site are illustrative rather than contractual: small differences of colour, tone and texture between a screen and the work itself are inherent to the medium and are not defects. Dimensions are given unframed unless stated otherwise.
Prices, duties and taxes
Prices are quoted in euros for each work individually and confirmed in writing before any payment. Starting prices shown here are indicative and exclude shipping, insurance, framing and any tax or duty raised in your own country. As works are dispatched from France worldwide, import duty or local tax may fall due on arrival: that is assessed by your own customs authority and is payable by you. Payment is arranged directly with the seller after confirmation of availability and purchase order.
Commissions
A commission begins with a written quote setting out the subject, medium, dimensions, price and timescale. A deposit is payable before work begins and is not refundable once the work has been started; the balance falls due before dispatch. Because a commissioned work is made to your own specification, it cannot be cancelled once underway.
Delivery and risk
Works are packed at the studio and sent from France by insured carrier to the address you give. Timescales are indicative, and customs formalities can add to them. Risk passes to you on physical receipt, so please examine the packaging on delivery: damage or loss in transit must be raised with the carrier and reported by email within 48 hours, with photographs of the work and its packaging, so a claim can be made.
Sales are final
Each work is unique and every sale begins as a conversation, so a purchase is final once you have confirmed it. The studio does not offer change-of-mind returns and does not send works out on approval. That is precisely why nothing here is rushed: before you commit you are welcome to ask for more photographs, exact dimensions, or a view of the piece in natural light, and the studio would far rather answer twenty questions than have you buy something you are unsure of. A work that arrives damaged, or that is not what was described, is an entirely different matter and is covered above. And where the law of your own country gives you a cancellation right that cannot be excluded — as it does for consumers in much of Europe — that right stands untouched by anything written here.
Copyright
Buying a work transfers the physical object and nothing else. Didier Breteau is the author and keeps the whole of the copyright in every work shown or sold here, including the right to reproduce and to exhibit it. You may not reproduce, photograph for commercial use, adapt, print or otherwise exploit a work without written consent — enjoying it privately in your own home is of course yours, but public or commercial use is not. Everything on this site, images and text alike, is protected in the same way. If you later resell a work through an art dealer or auction house in Europe, the artist's resale right may apply; it is paid by the professional handling the sale, not by you.
Your data
Only what your enquiry requires is collected, and it is never sold or rented. Because the seller is in Malaysia and the works are in France, your details necessarily cross borders — the Privacy page explains what moves where.
Law and disputes
These terms are governed by the laws of Malaysia, and the courts of Kuala Lumpur have jurisdiction. If you are a consumer, that choice cannot take away the protection of the mandatory rules of the country where you live. Please write first to studio@didierbreteau.com — most things are settled in a single email, and the studio would always rather sort it out that way.
